Terms of Service

These Terms of Service (“Terms”) govern your access to and use of i, operated by Ghozt Systems, Inc, doing business as GHOZT (“we”, “us”, or “our”), including its editor and related applications and services such as Scanner (collectively, the “Services”).

By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. The Services

i is a platform that enables users to create, publish, and view rich digital content. Content created and published through its editor is referred to as an annotation.

Content may be viewed on the web or through Scanner. Users may access content by scanning QR codes, opening links, or interacting with system-level link mechanisms (such as Universal Links or App Links).

2. Eligibility

Scanner and web viewing are available to users of all ages. Accounts are intended for users aged 13 or older (or the minimum age of digital consent in your jurisdiction, where higher). By using the Services, you represent that you are permitted to do so under applicable law and that you meet the applicable age requirement for the features you use.

3. Accounts

3.1 Account Creation

To use the editor, you must create an account using one of the supported authentication methods, such as email, Google, or Apple.

You are responsible for maintaining the confidentiality of your account and for all activity that occurs under your account.

3.2 Account Termination

You may delete your account at any time.

Upon account deletion:

  • Your associated annotations will be deleted
  • Certain data may be retained as required for legal, security, or operational purposes

We may suspend or terminate accounts that violate these Terms.

4. User Content

4.1 Responsibility for Content

All content (annotations) created, published, or distributed through the Services is user-generated.

You are solely responsible for the content you create and for ensuring that it:

  • Complies with these Terms
  • Complies with applicable laws and regulations
  • Does not infringe the rights of others

We do not pre-screen, review, or approve content before it is published.

4.2 No Endorsement

We do not endorse, control, or guarantee the accuracy, legality, or appropriateness of user-generated content.

4.3 Viewing Content at Your Own Risk

Users choose to scan QR codes, tap links, or otherwise access content created by others. You acknowledge that:

  • Content may be created by third parties
  • Content may be inappropriate, inaccurate, or offensive
  • You access content at your own discretion and risk

We are not responsible for any harm, loss, or offense resulting from viewing user-generated content.

4.4 Removal of Content

We reserve the right to remove content or restrict access to the Services at our discretion, including if content violates these Terms or applicable law.

5. Acceptable Use

You agree not to:

  • Use the Services for unlawful purposes
  • Upload or distribute harmful, misleading, abusive, or illegal content
  • Attempt to interfere with or disrupt the Services
  • Circumvent security or access controls

6. Intellectual Property

The Services, excluding user-generated content, are owned by Ghozt Systems, Inc, doing business as GHOZT, and are protected by applicable intellectual property laws.

You retain ownership of your content. By publishing content through the Services, you grant us a non-exclusive, worldwide, royalty-free license to host, display, and deliver your content solely for the purpose of operating and providing the Services.

7. Payments

The Services are currently provided free of charge. We may introduce paid features in the future. If we do, additional terms will apply.

8. Disclaimers

The Services are provided “as is” and “as available”.

We make no warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that the Services will be uninterrupted, error-free, or secure.

9. Limitation of Liability

To the maximum extent permitted by law, Ghozt Systems, Inc, doing business as GHOZT, shall not be liable for any indirect, incidental, consequential, or special damages arising out of or related to your use of the Services.

Our total liability for any claim related to the Services shall not exceed the amount you paid to us (if any) in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Ghozt Systems, Inc, doing business as GHOZT, from any claims, damages, losses, liabilities, or expenses arising out of:

  • Your use of the Services
  • Your content (annotations)
  • Your violation of these Terms or applicable law

11. Governing Law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.

If you are a consumer, this governing-law choice does not deprive you of the protection afforded to you by mandatory provisions of the law of your country of residence. Where applicable consumer-protection or data-protection laws of your jurisdiction grant you rights that cannot be waived by contract, those rights continue to apply regardless of this section.

12. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted with a new “Last updated” date. Continued use of the Services constitutes acceptance of the revised Terms.
